Emancipation in Virginia

I'm 15 and I live in Virginia. I live with my mom. Her and my dad split up last year. My dad is a drug addict and he is going to jail today more than likely. My mom owns her own business but she only makes like $150 a month and my dad pays $400 a month in child support. My home life sucks and i want to get emancipated when i turn 16. What are the requirments fo getting emancipated in virginia? Do you think a landlord will rent me an apartment when I am only 16? Do you think that it will be hard for me to get emancipated wihout my moms concent?

No one can say what a landlord may or may not do. My experience is that they will want to know if you will be a reliable tenant. Since you most likely do not have any form of credit, the landlord may also want a cosignor on the lease, so if you fail to meet your obligations they can go after someone that would be able to cover the agreement.

§ 16.1-333. Findings necessary to order that minor is emancipated.

The court may enter an order declaring the minor emancipated if, after a hearing, it is found that: (i) the minor has entered into a valid marriage, whether or not that marriage has been terminated by dissolution; or (ii) the minor is on active duty with any of the armed forces of the United States of America; or (iii) the minor willingly lives separate and apart from his parents or guardian, with the consent or acquiescence of the parents or guardian, and that the minor is or is capable of supporting himself and competently managing his own financial affairs.

Regardless of what you decide to do....

Being abused is not an emancipation issue.
