Eviction After Rent is Paid in Colorado
Unfortunately my September rent was past due and I was served an eviction notice. I worked it out with the manager of the complex so that I was able to pay the day after the eviction court date. Now because of that same financial situation, October's rent is late. I was told by the manager that if I didn't pay she would send me to the lawyer. My question are: Is she still required to serve me a 3-day Demand for Payment or Possession notice? Can she enforce the eviction from September after she accepted rent for that month? Thank you! :)

Typically, it would be necessary for your landlord to start the eviction process over again. I am not sure what happened on the scheduled court date, so I can't answer with any certainty.

My court date was on a Thursday. I spoke with the manager on Wednesday and explained to her that I could pay but not until Friday. She then told me that she would get the judgement against me on the Thurs court date, but wouldn't call the Sheriff if I had verified funds to the office before Monday of the following week. I paid on Friday as promised and nothing was done. I didn't go to the court appearance because she stated it wasn't necessary. So I'm wondering now if she hasn't served me the 3 day notice for October, could she still invoke the judgement from September even though she accepted payment for that month. :confused: Tks again!

Check with the court to find out what happened.
