By "dual fault" you mean that you were both deemed equally at fault?
You don't have to accept the determination of fault made by the police or an insurance company, although a court may end up agreeing with their assessments of fault.
Yes i mean we were both at fault, the insurance company says that she displayed what is called comparative negligence.
