Does Tenancy End if a Property is Sold
I have talked to a lawyer and he says that michigan takes the power of attorney. When i called the local courthouse they told me it was up to the judge. How can the judge make that decision and how can I go about talkin to the judge?

    Second Question:

I have someone that wants to buy the house but they want to with noone in there. I dont have a lease with the tenant and she hasnt been a good paying tenant either. I believe she has paid rent late ever time. But i dont mean like a week or 2, she waits till she like 2-3 moths behind then goes to the department of human service or the family independant agency and they pay for some. I had tried to evict her before and had given the p.o.a. to someone but he told me that I had to except any money that was given to me. Which I dont think I have to since she is doing this all the time. The next time she got behind like this I tried to evict her again and they told me they dont do the p.o.a but when i contacted a lawyer they say that courts have to honor them. But like said when i called the court house they said its up to the judge and I dont have the 1000.00 that the lawyers in Michigan want.

If I sell it to the interested party does the tenant have 30 days to vacate the premises or do I or new owner have to evict the tenant? If I send a notice to the tenant will it still work for the new owner or will he have to redo it all?

If you don't evict the tenant, and the new owner wishes to end the tenancy, the new owner would have to evict the tenant.

If you wish to give notice and be sure that the new owner would be able to evict based upon that notice, that's something you should work out with the real estate lawyer who handles the transaction.
