    California Speeding Ticket with LIDAR Calibration and Certification Issues
    Hi all,

    I received a ticket for doing 60 in a 25 zone. Submitted an informal discovery request a few weeks ago, requesting, among other things, "Copies of the maintenance, certification and calibration records, for the last twelve months of the speed measuring device that was used to ascertain the speed of the vehicle described in the above-referenced Notice to Appear;"

    Received the response today, but, curiously, the PD only included two sets of certification/calibration records ("Certificate of Calibration" and "Safety Test Sheet"): one from 2003 and one from 2004. Any suggestions on how to proceed? Two possibilities arise: (1) someone incompetently copied the paperwork or (2) the LIDAR really hasn't been calibrated/certified since 2004, which is a bit hard to believe.

    Would a motion in limine to prevent the officer from relying on the LIDAR information during the trial be in order?

    Send a letter to the prosecutor asking for the missing information. If it isn't produced, raise the issue in court.
