    US Citizen Married to an Immigrant with Asylum Pending
    Today is Oct 9 2007

    I am a US Citizen married to an asylum pending wife (in July 2006).

    -My wife has a asylum pending in Boston (before our marriage) and is still in pending.

    The following 3 forms were filed in July 2006 in New York City.
    - I485, application to register permanent residence ( scheduled interview in Jan 2007, but was cancelled don't know why. At this time, we are still waiting for a respond).
    - I765, application for employment authorization document (card was received).
    - I130, petition for alien relative (still on pending since Aug 2006 and we are still waiting for a respond).

    Thing I have already did...
    1-consultant though immigration lawyers.
    2-Infopass was scheduled.

    Questions need to ask you...
    1-Could my wife ( as asylum pending with an A number) get her green card through me (as a US citizen)?
    2-Any comments or suggestions that you can provide base on above information given.

    you have to wait for the I 130 to be approved before applying for a green card through the marriage visa. I beleive she can suspend/cancel the asylum process, your attorney would have to file a petition, however if for some reason the I-130 is denied, she cannot continue with the asylum process she can pending.
    In any case I advice you get legal help, it's not normal to get an appointment canceled

    and CML and mr. knowitall

    -My wife is ARRIVE ALIEN on her paper.
    -She is legally arrive alien and also asylum pending.
    -We found out her A-file is in National Record Center.
    -Her other half paper of document is somewhere else (maybe the Boston Judge has it).
    -We were requested by immigration officers that we have to see immigration judge in the future in Boston.(transportation and expenses are too much from NYC to Boston and we are trying to move immigration court into New York City)
    -We can not obtain an appointment for green card interview, it is because A-file and the other half paper document must re-route to the immigration building.
    -Regarding to CML advices (suspend or cancel the asylum pending may bring A-file and the other half of paper document together into immigration building). however,(what I think it could be true is that) she cannot continue with the asylum process she can pending...

    questions:
    1-Why the A-file and the other half of paper document were seperate into two different places, instead it should be in the immigation building?
    2-What should we have to do to bring the A-file and the other half of paper document together to the immigation building.
    3-Should it be immigration Judge's authority re-route the A-file and the other half of paper document together to the immigration building.
    4-Since the Judge has the record of my wife is legally arrive alien and married to a US citizen, Why not the Judge were just nice and easy pushing immigration building giving us a green card interview?
    3-What should we do now? Any comments or suggestions?
