LISTEN! Yes you are correct but pleading guilty without a prearranged Plea deal will not gurantee such a sentence. Diversion is not automatic. In fact if you plead guilty i would suspect a good chance that you don't get diversion although its still possible. furthermore the time to ask for Diversion is before court! Its part of plea deal. You plead guilty DA agrees to Diversion its a win/win. If you bring it up at court DA can refuse and if you still wish to plead guilty you get what you get. If you withdraw or change your plea because DA wont agree to diversion request you could piss off both DA and judge for wasting court time. Now for your own sake follow the advice given and consult with a criminal defense Attorney and when in court request PD if you cannot afford your own Attorney! If you still wish to pursue this on your own then you really have no need of this website

ok so because of my case before when i was 12 because of shoplifting it's subsequent.....will this make it harder for me to get diversion? or because i was a minor they won't really look at it like that? i'm really scared now.....if i get a public defender do you think they can help me better with this situation..being a "subsequent offense"

Qualifications for diversion vary for each state even each county. Ask your Attorney this as he/she will be familar with local laws and Judges reactions to this

have you ever heard of diversion after subsequent offense, i don't understand when i was younger and made this stupid mistake they told me it would be off my record. but they can still use it against you. do you think i will get jail, other than this i'm a good citizen i'm a full time student. who just made two mistakes.

Diversion programs (as stated) vary however having aprior will likely remove that chance however if it happened when you were a minor this could still work. Discuss this with your Attorney when you meet with him/her. Far as jail etc your Attorney will know the judges etc an dhow they sentence
