If your arrested you have an arrest record if convicted you have a theft record. Any $40.00 background check will bring the theft up
Today I hired a Criminal Attorney,
YES, he is expensive.
But he told me I will not have to appear in court until he tells me.
He told me the first appearance would be to Plea.
It could be 3-5 more court appearances until things are settled(?)
I really thought the first appearance would be to plea & get your punishment/judgement/sentence.(?)
I hope I did the correct thing here...

Deferred Prosecution:
Which includes:
court cost, 6 months probation & community serves.
Then the charges will be dismissed.
Question ~ does that also include my arrest record or do I need to try and have that expunged?
And how would I answer on a job application?
Also I still have not heard from the store for their civil demand yet, It has been over a month. I thought they would want their money straight away.
It appears that you can petition to seal your arrest record and, ten years later, petition for expungement. Assuming, of course, you stay out of trouble. Details are here.
You would answer questions on a job application truthfully. The answer will depend on the question asked.
Employers ask, on employment applications, if you have been convicted. You were convicted and should answer truthfully.
As far as Civil Restution goes, it could be awhile. Many retailers go through a third party to manage and collect their civil restitution. Any program I ever ran was in-house. You would of received a demand letter from me within the first week.
It's a deferred prosecution, which normally does not involve a conviction being entered by the court.
Thats what I thought but wasnt sure. In the six months before dismissal what is status of incident?
Conviction?
Pending?
Nothing?
what does the person put on job application?
If no conviction has been entered, they should be able to put down that they haven't been convicted.
