Ok just didnt want you to think there would be no more fines ther ewill be if convicted. Miranda is not required unless they question you. If they do Mirandize you and question you say nothing invoke your right to have an Attorney present

The summons is normally an instruction to appear in court at a particular date and time. The visit to the Sheriff's Department is most likely so that they can take fingerprints, and possibly mugshots.

I received a postcard from the Okaloosa Sheriff's office, Florida

It read Warrant/Summons for your arrest for Petit Theft
Summons was circled.

No date for court or anything.
So I am assuming they will give me a date when I show up tomorrow at the Sheriff's Office.

I really thought I would of recieved a court date first, Then it would be up to the Judge to say if I would have an arrest record.

I thought Petit Theft was a misdemeanor..{That is what I have been told} in Florida.
The lipstick was 8 dollars maybe even less then that.

That's possible; or they'll report to the court that you have been processed and the court will send you a date. If you don't get a court date and they don't tell you, ask them what to expect.

You should be consulting with a criminal defense Attorney many will grant an intial free office visit. at that time you can ask those questions. I am not familar with FL law but in some states such a small amount could be reduced to an infraction

I am going to make an appointment tomorrow, to talk with an Attorney, I want to see if I qualify for the Diversion Program.
After I finish at The Sheriff's office that is.
I am hoping they are open since tomorrow is a Federal Holiday

Today I went to the Okaloosa Sheriff's
Prepared to be processed...fingerprinted, photo taken etc.

That did NOT happen.
They just gave me a paper with a court date.

On my paperwork my sex, driver's licence number where incorrect.
I hope they do not come after me for the other person's crime
I did make an appointment with an Attorney.
He can not see me until Thursday:(
