Let me explain what happen...
I went shopping I picked up a lipstick...They had no tester for the color.
I continued shopping, I decide to test the dolor...
So Yes I did take the plastic off...Got side tracked was looking at other things,
put the lipstick with my purse...went to check out...
yes, forgot about the lipstick...
Walked out and the LP stopped me right outside the door.
I offered to pay for the lipstick...She said no.
Called the SP's & the local Sheriff's.
They took my information and let me go home.
YES, I was stupid...
I am so scared and embarrassed..
I am so worried how this will effect me and My son who is trying to join the Military...
Also does anybody know what type of charges & penalties I am facing, Do I need a Criminal Lawyer?
Will I have a criminal record?

Where we cannot say for certain I would guess unless you have other warrants or wants you will be finger printed and processed then given a court date.

I have no other warrants, this is the first time I have ever been in trouble.
I did not give any type of statement to the Sheriff, when this happened.
Does that make a difference?

Also, I am aware you are no a judge, but how do they handle
petit theft of a lipstick...

You will have an arrest record. Far as how they handle it if found guilty I would "guess"
. Fines less than $1000.00
. Community Servide
. Probation
. Possible ban from retailer
along with the unrelated Civil Demand. This may vary but its probably close

I already have been banned from the military exchange & commissary for a year.
Also the BX told me I will get a letter to pay $200.00
I plan on a plea of no-contest.
Since I am in the wrong, I walked out with the lipstick & forgot to pay.
I am hoping for a positive out come.

The $200.00 is Civil demand it is seperate from court fines

Why do they do a "Summons for your Arrest"...
Will they read me my Miranda Rights at that time?
I know that these are stupid questions, But like I have said I have never been in trouble in my 43 years.
