There is only one answer in Florida. If your parents will not file the emancipation petition, then you cannot be emancipated.
There is no answer other than that. No exceptions, no loopholes, no ways around it. Parents file, or no emancipation. Period.

My mom tries but she cant do much because she gets it twice as worse from my step-dad so she cant do much about it.
Actually, she can do a lot about it. It's spelled D-I-V-O-R-C-E, and she's played that game before. If you are BOTH living under these conditions, then you are BOTH living in an abusive environment. Unfortunately for you, you are not only the victim of his issues, but also the victim of your mother's lack of action to improve, alter, or escape the situation. Emancipation isn't going to be an option for you without her approval. So you might present your arguement to her in real black and white terms: "if YOU want to stay and be abused, that's your business, but you are making ME a victim too." Sometimes when people have lived in an emotionally abusive relationship over time, they loose sight of the fact that they are being abused at all - to them it's either too intimidating to try to change it, or too tiring, or they accept that "it's just the way things are". Remind your mom that today's situation doesn't have to be tomorrow's situation for either of you.
