    Dispute Over a Quit Claim Deed to an Alley
    Greetings, I am from Indiana and have a question. Long before I bought my current house the previous owner executed a "quit claim" deed to my neighbor for a city owned "closed" alley. Now my neighbor is saying that I have zero interest in the land that is between our houses and that the edge of my house is where my land stops. This alley is 16 feet wide and 130 feet long. My question is this: is quit claim deed valid if it is not listed anywhere in my titlework or mentioned at all in closing over 11years ago. In my titlework it states that any lien, incumberance, deed, or any like instrument should be listed at closing or know to new buyer as this could have affected our decision to buy. I have also paid all of the property taxes on this proprty since I have been here.:cool:

    What interest did the previous owner have to the alley? If in fact it is city owned land, perhaps none?

    Does your property survey or description on your deed include the alley? Was the quit claim deed ever filed and if so, when?

    First, let me thank the people who wrote back. The city(town) has no more interest in the land. It reverts to a suppossed 50/50 split between the affected party's being me and my neighbor. This alley is in every plot plan & survey I could find. It has a line drawn right down the middle of it to support the 50/50 thing. I do believe the quit claim deed was listed in the recorder's office but it is over 20 years old and I was not aware of this "lien" or deed prior to me buying the house. The neighbor is claiming the entire land amount.The previous owner had the same interest as I do. He quit claimed his portion to my neighbor because he wantd to build a garage. I think this is where all his fears come in and why he is fighting me. I as do others, believe his garage could be on my 8' section of the alley. I can't do anything unless I find out the validity of the quit claim deed.

    Take the title work to a local real estate lawyer, and have the transfer evaluated for its legitimacy under state law.
