    Third Offense Retail Fraud in Michigan
    I need serious help.

    About one year ago i recieved my first retail fraud and MIP at the age of 17 for stealing a $20 dollar hat and being Intoxicated.

    About 4 months later i was arrested with a friend for a retail fraud 2nd degree.


    I Have been on a 18 month probation now for all my charges.


    About 2 weeks ago i got arrested for retail fraud, MIP, and trespassing charge.

    The story for this is I worked at a Krogers grocery store for about a year and got fired for poor performance. I have been allowed to return to that store many of times to visit the Supervisor at the store whom is a friend of my moms. Infact shes the one who tells me to come visit her everyonce in awhile so i do.

    Anyways one night i was there visiting her son who also works there and while their i got bribed by some kids i know into grabbing a bottle of vodka from the shelfs and taking it to the back bathrooms and handing it off to them to pocket.

    When i grabbed the bottle and started walking i was immediatly spotted by one of the employees doing it so i willfully handed it back to him without any conflict or disagreement. I continued on my way to the door about to leave until one of the supervisors working said "No detain him now" and i was immediatly tackled by two employees. I was not running or fighting to get away. Infact i was already out the door and i was physically detained by two regular employees.

    Anyways they called the cops and i am being charged with retail fraud, mip, and trespassing. They made a statement saying i am not allowed at the store and have been repeatedly told to leave. Which is not true and i have one of the Supervisors as proof. The one who tells me to actually come back and visit her.

    Also when i had the alcohol i was holding onto it under my armpit and was making no intention to leave the store with it but simply hand it off to another kid by the bathrooms.


    Anyways i was wondering what i should do. Also all my prior crimes i have been convicted for are alcohol related or motivated. I have admitted to the courts that i am alcoholic and i am currently going to counsiling for mental health and substance abuse. along with attending alcoholics anonymous three times and a week as well as attending shoplifters anonymous on my own freewill.

    I know i am facing jailtime but is there anything i can do to not get locked up. I am not a criminal. I am a alcoholic with mental problems.

    Also should i press charges against Korgers for wrongfully detaining me?

    I don't think that they wrongfully detained you. I mean your intention was clear, to aid others in removing product from the stores possession. You were an accomplice and a willing one. You have no case.

    I would talk to the courts and beg for mercy. If you keep stealing, you will get locked up for a long time. Also, it appears that you are not that good at stealing, so I suggest you stop and find a new profession.

    Start attending AA. Keep a record of the meetings you attend. Get a sponsor.

    Thanks for the advice.

    And yes i am already suppose todo AA 3 times a week for probation but im doing the 90 meetings in 90 days on my own freewill and just picked up a sponsor a couple nights ago.

    Your sponsor is of same sex? Your sponsor is at least five years sober? As an active member of AA for 21 years I know how important these things are.

    Yes hes a male. I think hes about 27 and has been sober since he was 21. Real cool guy. Im a very shy person so he was the one who came up and asked me.

    I dont know much about this but I hope you figure everthing out and I wish you luck with AA and everything

    I also believe you do not have a case about the store detaining you.
