    Going to Small Claims Court
    Ok....So I got into a fender bender in California on Monday. I put in a claim through the other guys insurance because he hit me and he and I knew it was his fault. I finally got a hold of the guy insurance company and they told me that they weren't going to take the blame for it because it was a he said she said. Basiclly the guy said I hit him. Now i'm so angry because I know I didn't hit him he hit me. I also had a passager in the car with me at the time and he saw everything because he got hit on his side. He even told me when we got our "Sorry I didn't see you" My question, what do you think my chances are in winning the case to get my money back that its going to cost me to repair my car? Should I make sure the passager is with me at the court hearing?

    I assume that you do not have coverage. Get three estimates to repair and then get it fixed. You can file in small claims for the damage plus loss of use and costs. You will need a witness, pictures, the estimates and cancelled check. Many insurance companies, especially State Farm in my personal experience, are denying claims and forcing you to either give up or go to court.
