Trying to Avoid Sending Mom to Jail
We live in Illinois, an I had to have my mom arrested for criminal trespass at our residence. She is facing up to 6 months in jail, which I obviously don't want to see happen. I contacted the states attorney who siad that they cannot dismiss it now becuase its already set for trial. But they did say that if I don't show up for the trial the case would be dismissed. Is that true? Is that the best route now?

Prosecutors don't necessarily need the victim in court, but it makes it very hard for them to prove their case without one. Since this is a non-violent offense I would expect it to be dropped if you didn't show up.
If the DA told you it would be dropped then it probably will.
