    Eviction in Colorado After The Landlord Accepted The Rent
    Our Deposit Check was returned to our Land Lord at the end of Aug and we didn't know it and he didn't give use a 3 day notice or anything.

    Then we paid our rent for Sept. on time and with Certified Funds now he said if our deposit check isn't in by Friday he is going to post a 3 day notice can he do that?? :confused:

    You stated your deposit check was returned to your landlord. What do you mean?

    Did you give your landlord a deposit on an apartment and the check was returned to YOU with NSF?


    If you are required to make a deposit on an apartment and fail to do so the landlord is not required to rent to you. You have no contract (lease).

    But I am guessing at what you are trying to say.

    This is what happened we moved in our home in Aug entered into a Rent-to-own contract and then we paid our Sept rents and around the 20th of Sept our Landlord informs us that our Deposit check was returned to him?? I just wanted to know can he evict us after he took our rent payments??

    Are you asking someone on the forum if the deposit was returned to your landlord??
    First you said it was the August rent returned to your landlord. From where was this check returned. Did he lose it?

    Your not making sense.
    Did you or did you not pay rent for August and September?

    What is the question that you have?
