Emancipation of a Minor in Oregon
my gf is currently 16. she is graduating early this year so she can start college a year early. she has a job making over $600 a month. she pays for her car and clothes and a lot of her food. she also pays for anything else she needs. she does most of the household chores because her mom doesnt want to.. plain and simple. her mom only works part time and does not work summers.. my gf wants to know that when she gets her diploma and since she pays for most of her stuff if it is likely to be emancipated? she will turn 17 before she graduates.. she will continue to work and if her parents wont just let her move out then she will be emancipated. i personally have already read the majority of the states emancipation laws/code 419b.

Lane County Legal Services provides the following information about emancipation in Oregon:

Emancipation gives you certain rights of an adult. You must be at least 16 years old, able to support yourself, live on your own, and manage your own affairs. You need to file a Petition for Emancipation with the Juvenile Court in the county where you live and give a copy of it to your parents. The court will set a hearing to make the decision. The judge will decide if it is in your best interest to be emancipated by considering whether you have been living away from your parents and can support and care for yourself without parental assistance and supervision. If the court allows you to be emancipated, your parents will have no duty to support you, you will be treated as an adult under criminal laws, and you will have the right to contract, sue, and be sued. Emancipation does not give you the right to drink alcohol, vote, or marry.
That should be true statewide.

what she wants to know is that if she really needed to leave a few monthes earlier like in april if that would be possible given her circumstance?

Her best option is to get her parents' permission.

in oregon the parent does not have to give permission and the judge can "over look" the parents decision. but you must serve the parent in court once you file you must notify your parent
