    My Parents Threaten To Charge Me With Statutory Rape If I Move In With My Girlfriend
    Hi. I am going to be turning 18 and my GF will be 16 when I turn 18 (2 year difference). I have always been close to her family they have always helped me out and I was supposed to move in with her family when I turned 18 to help out until my GF can finish school. My parents and I dont get along and my parents don't want me to move out. They told me that I should drop any plans of moving in with my GF and her family because they would push legal charges. They said that i could be charged with statutory rape just for moving in with her. I wanted to know how real that statement is. Can i really be charged with statutory rape if her mom is ok with me moving in and my GF and I are not engaged in sexual activities? Can they force my GF to undergo medical test to determine if she has been engaged in sexual activities even if she and her mother (legal guardian) do not agree to testing? How realistic is this scenario? Just for the record I have been planning on getting an apartment with a buddy of mine just to avoid any possibility of legal prosecution but I am still curious as to whether or not I could be charged with any crimes just for moving into a household where there is a female who is considered a minor.

    If they make a police report, it is likely that the police will investigate. From that point forward, what they do will depend upon what (if any) evidence they find, or what the various people they question tell them.

    § 261. 5(b)-(d)
    Anyone who engages in an act of unlawful sexual intercourse with a person under age 18 and the actor is not more than three years older or three years younger, is guilty of a misdemeanor

    Anyone who engages in an act of unlawful sexual intercourse with a person under age 18 who is more than three years younger than the actor is guilty of either a misdemeanor or a felony

    Any person 21 years of age or older who engages in an act of unlawful sexual intercourse with a minor who is under 16 years of age is guilty of either a misdemeanor or a felony
    Up to one year in county jail

    Up to one year in county jail or by imprisonment in the state prison (period unspecified)

    Up to one year in a county jail or by imprisonment in the state prison for two, three, or four

    Well, what I really want to know is, can I be charged just for living there AND can they force my GF to be tested if her mother (legal guardian) does not agree to it. Those are the main things I want to know. Thanks for the above answers though they have further expanded my knowledge.
