Sixteen-Year-Old Wants To Live With Her Dad, in Illinois
I have joint custody with my ex-husband for our 16 year old daughter. The agreement has not been modified since it was placed when she was 10 yrs. old. My daughter thinks she wants to live with her Dad. I have many reservations against this because of past history. I know of two occasions where her step-mother gave her alcohol in her father's home. The father is an alcoholic. He suffered brain damage from head trauma received during a seizure. He seems to be left with difficulty clearly remembering timelines, past events, and some words are gone from his language. Suffice to say - not all the pistons are firing in there.
This past weekend my ex-husband snuck her out of the house after midnight on Friday and refused to bring her back home. I filed a missing person’s report the next morning when I discovered she was gone. This has never happened before. I didn't receive a phone call in the morning that she was at his house. I feared she had run away.
I am also preparing to file for sole custody and petitioning for payment for in-a-rears support payments that are over $15,000 behind. I have not been aggressively after him for the monies because he has been on disability from the injury and not working.

This must be in response to the temporary Civil No Contact Order you filed.
Where is she now? do you know? When do you go to court this week?
Did you retain an attorney to help you with this? Hopefully, some of this will be more clear to the court when you present your case. Her father has alcohol problems, if you know for a fact that he is the father, you'll be dealing with incest issues, and I understand your primary concern is for her to finish school.

I could be wrong but I do not believe disability payments can be attached. So gett anything (much less arrears) may prove difficult. If your Exhusbands current condition prohibits his ability to care for the child while under his care you could prvail. However a 16 year old can care for herself while with Dad. I would discuss this with an Attorney before seeking modification. Dad has a right to see his child, question is, is it safe for her to stay with Dad

The 16 year old is NOT pregnant by her biological father. She is pregnant by an 18 yr. old. - different thread.
The question is can I change from joint custody to sole at this stage of the game?
I JUST found out about the alcohol in the last 30 days from the now 16 yr. old who confessed is occured when she was 14. How can I not do anything about it? - well - I AM.
I'm seeing an attorney on Monday to try to file for sole custody to remove that influence all together. Her father snuck her out on Friday night (two days ago) without my premission and she is still not home. I have called and warned him he violated the visitation order - but no go. I will be calling DCFS and local law enforcement to report her missing too.

all you can do is try.
When you speak to the attorney, you might ask him about filing for a contempt of court charge against dad for spiriting the child out against court order.
