    Need Out Of Lease Due To Buying A Home
    I signed a one-year lease 3/05. I bought a home and will be taking ownership of my new home 10/05. My lease says that if the lease is broken I should give a 60 day notice and pay an extra months rent. on aug 31, 2005 I gave a notice to vacate on 10/31/05 which is 60 days notice. the property mang. called and said that if I did not pay the extra months rent now then the 60 day notice would not be excepted. I told her that if she accepts it or not, the fact of the matter is that she still has the notice that I will vacate. Am I correct or not? I can't afford to pay her the extra rent now. what should I do?

    You have to check your lease to see what it says about when the additional month's rent is due.

    Reply: breaking a lease due to buying a home
    It says, Resident agree to pay Owner a Break lease fee in an amount equal to one month's rent at the time at the time notice is given and forfeit security deposit. Is that legal? Can everything in a lease be considered legal and binding if you signed it?

    The lease seems pretty clear.

    The lease is a contract. Many people have no similar provision in their lease, and risk being held responsible for all rents through the conclusion of the lease.
