17-Year-Old Charged With Retail Fraud
I was caught shoplifting and taken down to the Police station for finger printing. I'm 17 years of age and has no criminal history. What can possibly be done to me? Can they really sentence me to jail for 93 days? I live in Grand Blanc, Michigan and attempt to steal $80 worth of merchandise. I need some advice of how to handle this.
Note: I now this was really stupid of me!
Re: 17-Year-Old Charged With Retail Fraud
93 days for shoplifting someone fed you some bull or you have priors
Re: 17-Year-Old Charged With Retail Fraud
She's noting that it's a 93-day misdemeanor - a maximum possible sentence of 93 days in jail. For a first offense, probation (plus fines, possibly plus community service) is the most likely option. You may wish to discuss your case with a local lawyer to see if there are any diversion programs available in your county, or if you should seek a deferred sentence (e.g., under Michigan's HYTA law).
Note that at 17, Michigan will prosecute you as an adult, and you get an adult criminal record.

My court hearing is on October 1st. How do I get in touch with my lawyer? How do you know if you have a laywer? I was asked if I needed a lawyer the night of the incidient but it never came up again. How do i get into this Michigan's HYTA? How do I ask for a deffered?
Re: 17-Year-Old Charged With Retail Fraud
You search the yellow pages and find a criminal defense Attorney or you wait till court date enter no plea or not guilty and request a public defender
Re: 17-Year-Old Charged With Retail Fraud
So I wait till I go to court this Monday and enter a no plea. What if I plea guilty can I still ask for a public defender? Do you have an extimate idea of the court charges?
Re: 17-Year-Old Charged With Retail Fraud
If you plead guilty you will be convicted and, depending upon the court's policies, either sentenced right then and there or referred to probation for a pre-sentence investigation and report.
Re: 17-Year-Old Charged With Retail Fraud
Ok so say if I was to enter a no plea can I still ask for a diversion programs? Do I have to answer anything without a laywer/public defender? What can I expect when I go to court this Monday?
Re: 17-Year-Old Charged With Retail Fraud
You can expect the case to be continued without further action or questions. You can expect the judge to give you instructions on how to request a Public Defender
