Collection Case Dismissed, What To Do Next
I was issued a civil summons by a credit card company. I live in Ohio. I responded to the summons within 30 days disputing the amount I owed. I had this document stamped at the court. The credit company had some law firm working the case for them. A court date was set.
I showed up in court last week for our court date and I was the only one who showed up. The judge dismissed the case on account of the lawyers for the plaintiff not showing up or asking for a continuance. What should I do now? The judge told me to wait for the law firm to contact me again and we should "work something out". Since the case was dismissed do I have any leverage here? I dont want to sit back and wait for things to happen, I want to be proactive so I can do whatever I need to do to get this off my credit report. Any help great appreciated!:D
Re: Civil Case, Plaintiff(Credit Card Company) Not Present
If it was dismissed "without prejudice", as was apparently the case, the lawsuit can be refiled.
If you want the negative entry removed from your credit report, you have to try to negotiate for "pay and delete". They do not have to offer you that option. If they do offer it, make sure everything is confirmed in writing before you pay.

Is there any other kind of dismissal? I dont remember the judge specifying what kind it was.
