    Credit Card Debt and Threat of Felony Charges
    Yesterday I got a call from my parents (away in college) telling me that a collection agency/firm wanted to talk to me. I called the agency back and come to find out that I am being sue on an old credit card that I had my freshman year in college. I due remember the debt on the credit card was $800-900 now their saying that there sueing me for $6,384.46 for interest and attorney fees.

    The gentlemen also told me that I will be summoned to court on the charges and if I dont pay, that I will be charged on a count of felony for fraud charges on the misuse on a credit card is that possible? Can I really be charged with a felony for not paying my credit card debt? I even asked him if I can do monthly payments and he said that I can only settle out of court for half the claim or the felony charge will be brought up against me. I completely dont understand how this is possible or not? Can you please help thank you.

    The debt accrued how long ago, in what state? The contact is from the original creditor, or from a separate collection agency? What is the factual basis upon which they could supposedly file a felony charge?

    The debt occured in 2001 in the state of Florida. The contract is from Version Credit Card which I guess they transferred everything to a debt collecting agency. Their filing it on the bases of me not making payments on the credit card. I dont even have any of the paperwork which what I am trying to get now from them now. I am totally confue about this whole situation.

    If the default occurred in 2001, it appears that the statute of limitations would have run. Also, a debt collector should not be threatening criminal charges in order to try to scare you into paying a debt. Consider filing a complaint with your state attorney general's office.

    So let ask you again so there is no way that I can be charged with a felony for fraud on a deliquent credit card debt at all? That is my main question to you please.

    I am not familiar with the facts, or what you allegedly did which could be construed as fraud, so I cannot add anything to my prior statement.
