Re: Cops Have Been Called
I'm confused. Are you saying that the minor lives with you?
Re: Cops Have Been Called
No i'm sorry i'm a wreck i'm moved out of the house about a month ago
Re: Cops Have Been Called
But prior to that you were living in same house and dating (with no sex you say)
Re: Cops Have Been Called
Yes this is true i just want to know what they can charge me with.
Re: Cops Have Been Called
First you need to know that even though you had an expungement for the previous offense, that does not stop a prosecuter from using it in a subsequent trial. And the bar for conviction in the eyes of a jury is now lower. You could be charged with a crime even though it did not happen, but getting a conviction would be another point. You did the right thing by moving out and as long as you are telling the truth about no sex, no fondleing, no nudity in her presence, no anything even remotely sexual in nature, you will be fine. As for the abuse she is being a victim of, you can notify the Child protective service of the welfare division and let them do the investigation. Otherwise please stay out of this situation for your own good.
Re: Cops Have Been Called
I thought that prior acts are not admissable?
Re: Cops Have Been Called
Prior acts may be admissible to demonstrate motive, opportunity, intent, preparation, plan, knowledge, identity, or absence of mistake or accident. In any particular case, it will depend upon the full context of the prior act, the state's rules of evidence, and case law.
