Child Support Cap in Florida
Is there a cap for child support in Florida?
My son (13month) was born in TX. His father decided on an amount to give me each month. I did not file for court ordered CS.
His father is a physician. He makes about $17,000 a month. (I have seen his check) In TX, there was a cap so that was how he justified the amount. (TX = 20% of the first $6,000 made each month) He pays over that, and I currently receive $2000 each month.
I am considering filing for CS in Florida where I now live. I am wondering if my son and I are entitled to a larger amount? I tried the calculator site, but am not sure if it is accurate. I hate to sound money hungry, cause it isn't about that. But I have been 99% on my own since his birth. If we are entitled to more, I will accept it.
I pay for health insurance and pay almost $900 a month for daycare as well. I just want my son to live the life he would have had if we were together. (sounds silly, but that is the point of child support - maintain the needs and lifestyle. and i mean things like a house and private school)

No, there isn't a cap on CS in Florida. You can read the CS guidelines and statutes 61.30 at www.flsenate.gov/STATUTES. It explains how CS is determined when the combined incomes exceed $10,000.00 per month. It also explains how health insurance and day care costs are determined and figured into the amount that will be ordered.
There is one thing though, most likely, Florida laws won't do you any good. You can file in Florida, but since the father lives in another state, the case would be forwarded to Texas for jurisdiction. Then the Texas laws and guidelines would be used. IF you have any court orders in TX for custody or divorce, you would need to file in Tx.

My son was born in TX, but his father left and moved to GA before he was born. Then a few months ago, I moved to FL. We were not married, and we have nothing court ordered (custody, visitation, or child support)

You won't be able to file on your own in Florida until you've been a legal resident for 6 months or longer. Even when you do file, it's very likely that the case will be transferred to GA. Since GA laws will apply anyway, why don't you go ahead and go to the Florida Dept of Revenue CS enforcement to begin the process? They will take all your info, then forward the papers on to GA for processing to get a GA court order. You can find your local office by calling the state number at 1-800-342-8011.
