    Underage Consumption Charges
    hi everyone, im patrick, im 17, and a senior in highschool.

    last night at our opening highschool football game i was caught along with about 20 others with underage consumption. I blew .05. :wallbang:

    we were on school grounds and in the stadium, only after the first quarter, i wasnt leaving the game or anything i just got pulled aside randomly by my administrators for a check. (which is that legal?)

    what im told is im suspended 9 days, or 3 if i take alcohol abuse classes for 4 days, which i am doing.
    but they told me i will have my license suspended for one year of my court date.
    which im confused upon because isnt your license taken away for one year for DUI? which i wasnt? nor was i even .08, which i know is 21+ standards.

    also i wasnt leaving the stadiuum to my truck or anything which gave them no reason to beleive i was driving or would be. Plus i had purposely locked my keys in my truck, along with my wallet and license. Therefore i didnt have them on my at the game when caught.

    Im just also confused on how im getting a driving charge for a un-related offense.

    Any advice?

    What state did this happen in?

    I can tell you that many states have adopted a "zero tolerance" policy/law that - whether you are in a vehicle or not - it does affect your driving privledges.

    im in georgia
    i beleive we do follow zero-tolerance
    but i think a year is a bit high? esepcially for only .05....

    im pretty certain we follorw the Zero-Tollerance thing

    but i think 1 year is high for my first offense with cops EVER...and only being .05
    and never in trouble at school plus good grades, never had a accident in my truck.
    nothing in my life but this.

    Also, since this is your first offense, you are eligible for a diversion program. So that is good news for you.

    That it would be a 12 month suspension of your driver's license.

    A diversion program is available for first time offenders. You, basically will enter into a probation period and have conditions that you will have to meet. During this time the court will not enter a judgment of guilt and if you are successful at completing the terms of your probation.... Then the court will discharge the proceedings.

    You can choose to hire a lawyer or possibly you will be eligible for a court appointed lawyer. They will be best to advise you and help you with this charge.

    I just realized the link I gave you didn't bring you to the statute that I was referring to.

    You can go to that site and type in the code of your violation and it will bring you to the statute I was referring to.
