Suspended License Due To Insurance Company's Error
I have a friend in Virginia who was pulled over and given a ticket for driving with a suspended license. As it turns out, her insurance company "AllState" neglected to send required paperwork to the DMV back in January. AllState admits this in writing. So, she has been driving un a suspended license for months without knowing. Afterall, she has been paying the insurance bills and AllState's records show her as having a valid license.
The question is: Is there a way to make this all go away before her court date (talk with the officer - can he do anything to help?). Yes, she could wait and explain it to the judge, but it remains a dark cloud, until that date. Further, it is in the DMV records now. Even if the judge tosses it out of court, how does it get removed from the DMV records (otherwise insurance becomes $$$$).

Allstate can take care of this quickly (as in almost instantly). 7 years ago, when I worked in customer service, I could take care of this in about 3 minutes on the phone. I'm sure the process is much faster today. Having said that, was there ANY lapse in coverage, even if it was only for 24 hours?

I agree. It is up to Allstate to notify the DMV of the error. If she gets stopped again she could easily go to jail.

She or her attorney would really need to talk to the prosecutor handling the case--her situation is what I would call a suspension due to error. If she furnishes the prosecutor with info from the insurance company showing the error, he or she may move to have it dismissed so she does not have to show up in court. She would also then need to follow through with DMV to make sure that they removed the suspension from her driving record. These are two different things she would need to address seperately--one with the Court and one with the DMV.
