Came to America as a Baby
Hi, my friend's situation is similar to one listed a few threads down. His parents gave birth to him while on a year-long business trip to Canada. When they went back to the United States, he received a visa with no expiration date on it. His parents are citizens, as are his 3 siblings. Now he is 23 and wants to get married to a citizen. Is it possible that because of the situation, and since he had a legal visa that he would not be required to go back to Canada and wait for his wife to fill out paperwork?

His parents were both U.S. citizens as the time he was born?

No, they weren't. At the time of his birth they were on work visas, but his 3 siblings were born in America.

I don't know what his status presently is (if he's out-of-status or remains on a valid visa), but either way he should be eligible to adjust his status on the basis of marriage as he entered the country legally. If he is out-of-status he should not leave the country without checking with an immigration lawyer, as his departure could trigger a lengthy period of exclusion.
