Husband Wants To Take My Last Name
Hello.
I need some help. I am American and my husband is Canadian. We live in America together and he has his Permanent Residence card (his green card).
We got married in Tennessee and lived in Georgia at the time of the wedding. Right now we live in Florida, but we may be going back to Georgia in a few months, we are really not sure what we are doing right now.
My husband wants to take my last name and we can not figure out how to do this. Things are definitely biased towards men taking their wife’s last name as opposed to the woman taking the man’s.
When my husband applied for His US social security card and when we filled out all the immigration paperwork we used his “new” married name. He got his social security card with his new name on it. He also got his temporary work permit with his new last name on it as well.
However, when my husband and I went to the immigration office for the interview to get his green card, the lady who interviewed us told us we couldn’t get his green card in my last name. Which I don’t understand because that’s how the women do it!
So right now we have a green card with his last name and a social security card with my last name on it. We have filed all taxes with my last name.
We are lost about how to get his name legally changed to my last name. Can anyone help with this? Does it vary state to state? I think because he is a permanent resident it makes it more complicated. We want to get his Canadian passport but we want the new name on it. We also want his green card to have the right name. It can’t be good to have the social and green card different. Thanks.

Did you try filing an I-90? If they're being stubborn about it, he may have to get a court ordered name change apart from the marriage, and get a new Green Card based upon that court order.
