Second MIP in Michigan

Hi, so almost a year ago i got my first MIP when I was 17. The judge gave me non-reporting probation for 11 months and I had to take an alcohol awareness class. I would have succesfully completed my probation this October, however last night I was arrested again with 4 of my friends resulting in a second MIP and I am now 18. I blew a .05% and was very compliant with the police. I was allowed to leave the station about 20 minutes after I got there because I was already sober. I just don't know what to expect for my court hearing next week and was wondering if anyone knew about what I'm going to be looking at. If I should be looking into a defense lawyer?

It can never hurt to consult a criminal defense lawyer. Right now you're looking at both a probation violation and a new criminal offense, which won't make your judge happy.

I tried to get in to see my PO today but her next available appointment was next Friday and my court hearing is the Monday before that. So maybe someone here can shed some light on this- can you be on probation in two different counties? Or is probation a state wide thing? I was hoping to see my PO so they could at least give me a peace of mind as to what to expect this Monday but that isn't going to happen.

Probation is by county. If you hire a lawyer (or obtain a court-appointed laywer) your lawyer should be able to find out what the probation officer's recommendation will be, although the recommendation is sometimes not available until the day before the court hearing.

So I went to court in the second city last Monday. I put in my plea and I plead guilty, but my actual sentencing date isn't until October 28th 2007. Now I was supposed to be off my first probation October 11th 2007... so am I still in violation if I haven't been convicted yet? Or does it go by the day I was arrested or put in my plea?

You violated your probation when you committed the new offense.
