Evidence Disappeared - Will The Charges?
I was detained by police, while suspected of poss of paraphenalia, three small bags were found in the glass of water I had been holding. I don't think any solids were retrievable, can the police still charge me w/ drug possession from wet bags? If so, how can they determine how much was in them? 2 were empty, 1 almost empty, in 8 oz water? Also, $720 in cash came up missing after I was taken to the ER instead of jail, I assumed my property was in police custody, too, but now they deny any knowledge of it, should I keep my mouth shut until after charges have been filed? One more ? I am moving back to TX asap, what happens if I leave before court or even after? Hating Arizona...@ 115 degrees who cares if it's a dry heat, which it is'nt anyway
Re: Evidence Disappeared - Will The Charges?
They can test the water. If it tests positive, that's possession.
Do what you want with the cash. Wherever it went, it's effectively down a black hole and it's not coming back to you in this lifetime. Besides, if the police did recover it (at least where I'm from) they would probably try to have it classified as drug-related money and pursue forfeiture.
If you leave before court you will be a fugitive, and they will issue a warrant for your arrest.
Re: Evidence Disappeared - Will The Charges?
Thanks so much for the info, sounds like I'm going to be in for a ride. The investigator for my money missing has told me that the police have denied any knowledge of any money and that their stories matched, go figure. I didn't realize the black hole theory was happening, silly me, I thought when that cop was telling me how important honesty was to him, it went both ways, sad. I guess he gave me what I gave him, though. I was clean for almost five years, until January, I relapsed. I've been caught in the grip & am trying desperately to get back into my NA program, where I know I can recover, I just thought I was different. I'm not, I'm an addict, text book case. Thanks again, if nothing else, the money will be a small price to pay for my mistakes.

If it makes you feel better (it probably won't), the most likely offenders for the missing money are low-wage hospital employees.
