    Making a Claim Over Aquafina With A Fly In It
    Hi,

    I am new to this forum and just signed up to ask this question.

    I took business law I and II in school so I am not completely numb to the law.

    Anyway...

    I purchased a bottle of fine Aquafina water a few weeks ago.
    Before opening the bottle I noticed a nice cruddy little fly floating on the top. This bottle is not opened, factory sealed with a fly.
    I understand the odds of this happening are pretty slim to none, but it did, and I have it.

    Should I be afraid to drink bottled products for the rest of my life?
    Should I have nightmares about maggots hatching from my stomache?

    If so, what do you think that could be worth in a New York civil court?

    Please tell me a million bucks....

    Any advice is appreciated.

    Oh yea, the bottle is listed on eBay right now, but I think I am going to cancel the auction.

    Forgive me for not searching similar posts before asking my lame question.

    I guess if I can get more than the value of a few cases of Aquafina for the fly bottle on eBay I am doing pretty well.

    I guess it could be kind of a collectible.

    In order to win in a law suit (and you should know this) you need "damages" you hav eno damages as you did not drink the water and if you did you would need to get sick first! Your total take on your greed is zero! By the way food makers are allowed a certain % of rodent , roach droppings and other disgusting items. It is rare but not unhear dof for insects to get bottled by accident in food and somehow make it to store. I use to know a liquor store owner and when this happened he put bottle aside to go back to supplier. Its really rare to make store shelf but in your case it did. Take the the bottle back and have it replaced or get your money back.

    If you try to make a claim, the bottling company will insist upon inspecting the bottle and fly to determine how it may have entered the bottle. They would look for signs of tampering, or any way a fly could have entered the bottle after it left the plant before it reached the consumer.

    The odds of a $20K settlement where no injury is suffered seems like wishful thinking.

    Perhaps the business where I purchased the Aquafina could sue for damages based on the fact that I will never buy anything from them.
    Regardless, I have no desire to feed the bank account of a lawyer to sue for me.
    I am almost up to $50 on eBay, I can live with that return on my $1.50 investment!

    I attempted to get on CNN, just because of the recent announcment that Aquafina is simply Los Angeles public drinking water anyway.

    I did however get featured on numerous "Weird Auction" websites.
    At least I got one of my auctions immortalized on some goofy website.

    now that I know 50$ can be made off a $1.50 bottle of water, I'm purchasing a machine that puts the caps on bottles, as well as starting a fly farm and buying a whole lot of aquafina!

    I'm gonna be riiiicchh!

    From time to time, upon opening a bottle of pop or water, the entire cap comes off (including the ring that is supposed to break off when you open the bottle). And of course, it can be screwed back on.

    or if you are trying to do this, it is possible to do this without breaking that ring and not all that difficult.

    To remove the plastic cap w/o breaking the taper-resistant safety ring seal from any plastic bottle-
    • heat one cup of water in microwave til it boils
    • hold bottle upside down and insert bottle's top
    approx. 1" into hot water for 45 seconds.
    • remove bottle and immediately and slowly
    unscrew bottle cap.
    • add foreign objects sparingly being mindful
    that the more improbable the object is, the less
    favorable your pleas bargain will likely be after
    you're convicted (ie. Wendy's chilly finger case)

    I am pretty sure tampering with products to resell like such is illegal. Especially if someone you sell one of those altered bottles to drinks the water and gets sick. You are going to have something else to worry about..
