Marrying an Immigrant on an Expired Visa
My friend just met a man from Equador 2 months ago. He came here over 10 years ago on a visa, which has since expired. He is still in this country, which I am assuming is illegal. They are talking about getting married VERY soon. She is crazy about him , but there is something about him I just don't trust. I feel like he's trying to marry her to obtain legal status here in the States. Would that be possible, and if that is the case and he marries her and then becomes legal and then leaves her, what damages could she endure?

If she signs an affidavit of support and he ends up on public assistance before the period covered by the affidavit expires, she could be required to reimburse the state. Keep in mind, though, that they'll have to be married for at least two years before he can get his Green Card out of conditional status.
