Violation of Felony Probation
My fiance was on felony probation for selling rock cocaine in California. He left Cali without applying for probation transfer and moved to NE. While in NE he got a DUI and a driving under suspension. He did his time for that but never paid his fines so there was a warrant issued. He was then picked up for speeding, and since he had a warrant he was taken in. It was then discovered that he had a warrant from Cali for violating his probation and they are now going to extradite him. My question is what do you think they will do. He has been in NE for two years and the warrant was just issued in June of this year. He was supposed to serve 5-7 years in the penn, but inistead served two and was sentenced to four years probation. Do you think they will make him serve the 5-7 since he moved and didn't report to his probation officer??? Any advice would be appreciated!!

Whatever sentence he receives on the original charge, he will get credit for time served. He should retain a criminal defense attorney in California to advise him as to the probable outcome of his probation violation, strategy in relation to extradition proceedings, and to advocate on his behalf at the probation violation hearing and sentencing. (If he cannot afford a lawyer, he should seek to have one appointed to represent him.)
