    I WAS ADMITTED INTO THE US IN 2001 ON AN F-1 STUDENT VISA,i WASNT ABLE TO ATTEND SCHOOL SINCE 2002 FOR FINANCIAL REASONS,I NOW REALY WANT TO VISIT MY COUNTRY BUT I AM AFRAID.mY vISA EXPIRES NEXT YEAR IN FEB AND AM AFRAID IF IT DOES AM STUCK HERE FOREVER!!! HOW CAN I MAKE IT SO I CAN BE ABLE TO VISIT AND BE ABLE TO RE-ENTER???? HELP AM DISTRESSED!!

    To re-enter, you would need to obtain an appropriate visa.

    Sir,

    There are a lot of questions that need to be asked (and answered) before one can fully advise you on the necessary steps. For example, what is your marital status, what do you do, what do you intend to do upon return to the U.S., your country of origin and the local policies of the U.S. Consulate, etc.

    In general, given your F-1 status, and assuming you had a "Duration of Status" in your I-94 card, you DID NOT accumulate any unlawful presence in the U.S., and technically, you are not subject to a 3/10 year bar. However, a Consular Officer may take into account your violation of the visa terms, and your failure to timely depart from the U.S.

    You should consult with a U.S. immigration attorney.
