ok.my boyfriend has been in the US for 2 years and his visa has expired. i want to help him get it but i dont know how i can. we talked about getting married and i think hes ok with it but the thing is if i get married with him i dont know what to do from there...do we just apply for it...will they send him back. another thing is my age. im 16 and hes 21...my parents are ok with us. but i dont know if we can. i dont know what to do and how to do it...my mom says i can get married with him with my parents consent. and then we apply for the visa again..but im scared if we do it like that they will send him back since its expired and he didnt do anything about it. what should i do..and how should i do it???

"Normal" process if for US citizen to File i130 petition for alien relative. Alien relative fileds i485 to adjust status from "out of status" to legal permanant resident. Alien relative would NOT have to return to his home country first. You go through an interview and you must show proof of your life together, that it is not a marriage just to obtain immigration papers.
Process can take from 1-3 years depending on the complexity of your case.
You have a couple unique factors. Your age first. You may be able to legally marry in some places..that is the first thing you have to find out, to make sure that is at least a possibility
Second, even if you can marry, you still cannot legally enter into a contract until you are 18. I do not know if the filing of these petitions constitutes a contract?? The forms and paperwork I have read do not really address that situation.
Third, as you read up on the process, you will find a section where you as the petitioner have to show proof of support, meaning you have to be able so show that you make enough money to support him. At 16, I would doubt it, so someone else would have to be willing to provide an affidavit of support.
Finally, it is going to cost a lot of money. From $2000-$6000 depending on if you decided to go with an attorney. Since your situation is NOT "normal" I would highly recommend you speak to a lawyer who has experience in immigration issues.

:confused:ok...so your saying in some places i might be able to marry...i know this girl and her husband and her just got married...shes 19 now and hes 30...hes from mexico he works with my bf...they have known each other since she was 13 and she go pregnate by him..she was going to marry him at 16 but her mom wouldnt consent to it...does that mean i can...also. even if we can marry you said something about me having to be 18 to enter a contract...what is the contract for...and the last question is i am working but its not enough to support all of us because i have a baby(not by him). but hes working to...can we use him too or just me? and he has a lawyer already i just havent talked to him myself...what would be some good questions to ask him about my problem??

The Marriage and the Visa are two seperate issues. You have to find out IF you are allowed to be married in whatever county you live. If your parents have to consent, or whatever, that is the first thing you need to find out.
Supposing you are allowed to marry, the first step in the process is for you to file an I130 Petition to sponsor the alien relative (your spouse). The question you need to ask the attorney is are you allowed to sponsor him if you are not 18 years old yet.
With regards to financial support, no you cannot use his income. Someone independant has to sign a form that says they will provide support for him, so that the government will not have to.
Now, since i am giving you this advice for free, I expect you will at least consider the following. You are NOT making the right decisions!!! I know you probably have heard this before, but please consider the following.
It happens thousands of times each day (Read more on these forums and you will see)..This man MAY be looking to use you just to get the permanant resident card. Since you have a child and are not married to the father, I hope that you have learned from that. That the situation was probably not as you had thought it was.
You are going to end up spending thousands of dollars for the forms and attorney fee's, you or someone you love will have to be financially responsible for him, and he can up and leave you after 3 years, once he gets his green card without any consequence to him, but HUGE consequences to you. It is not worth it
