Help With A Master Calender Hearing
:confused:My Fiance and I are both Jamaican. I was born here and he was not. He came to this country in 1982, graduated from high school here and even served 4 years in the US Marine Corp. with an honorable discharge. In 1995 he was convicted of drug traffiking and served less than a year and has kept his nose clean ever since. June 1st of this year 2 agents from INS came and detained him because of his felony. He is currently out on bond awaiting his Master Calender Hearing on 8/15/07. I'm really worried because we haven't been able to afford a lawyer. Can he ask for addtl time to seek counsel. What really has me worried is that the letter sent by the Immigration court stated that he is to be represented by counsel on the date of his master calender hearing. Does anyone know if the judge will give him addtl time? Also, does it sound like he has relief under a 212c waiver? We have 2 girls and 3 boys, and we are trying to fight this but it seems like we can't get any help.
Re: Help With A Master Calender Hearing
If he's not actively trying to find a lawyer right now, why should he be granted additional time?
What do you suggest would provide the basis for a waiver?
Re: Help With A Master Calender Hearing
We are trying to find a lawyer, but because he has just started working after a layoff we cannot afford a lawyer. As far as the waiver I thought that if you were convicted prior to 1996 that the 212c waiver was a form of relief available.
Will the court take into consideration his military record?
Re: Help With A Master Calender Hearing
If the only basis you can present for a waiver is that, prior to becoming a drug felon, your fiance served in the military, I would not expect the waiver request to get very far.
He is either trying to get a lawyer or he isn't. If he isn't trying because he feels he can't afford a lawyer, then he isn't.
