    Scammed In A Finance Deal After Bankruptcy
    We are being scammed!!

    My husband and I did one of those owner finance deals after bankruptcy. The owner of the house we bought held a closing and the deed and title are now solely in our names. The previous owner is simply the garuntor on the loan. The house payments have been made on time and are current. The previous owner has decided that he wants the house back to sell again and make more money. We have done about 50k worth of remodeling and he wants it back to sell outright and make a huge profit over what he sold it to us for. He has fabricated a bill that he says we owe him personnaly and has threatened to foreclose on the deed due to default because refused to pay the bill. Time being of the essence, we paid the fabricated bill of $526, but he still directed his attorney to proceed with foreclosure and now our name is in the saturday morning paper in the legals. We do not pay him the mortgage payment, we pay the bank, and the bank is not involved in the foreclosure. How can he do this? Is this legal? What is our recourse? Is this criminal?:wallbang:

    Are you saying that you have not been paying on a second mortgage?

    No, we have not been paying on a second mortgage. There is only one mortgage at the bank, and the payments have been and are current.:wallbang:

    We did that. We are waiting to hear from him as to what our next move is. We are in Georgia, does anyone know about Georgia lending laws and foreclosure laws? Can we sue him for deffamation for running this legal ad in our local paper? Is there anything that we can do legally to stop this man?:wallbang:
