Summons for Petit Larceny
I currently have a summons for petit larceny. The date stated on the summons is in late september. The incident happened a few days ago. How long do you suppose it will be before it goes to trial and this whole thing is resolved?
This is my first offense. I am 26. It is New York State. The items were under $250. There was a burglary tool involved.
I am going to set up a consultation with a lawyer next week but if I can have a little info or advice before hand then maybe I'll be able to calm down a little, because I'm obviously beyond panicked.
Please don't be nasty or judge me. I don't need to be kicked when I'm down. Thanks.

Thanks. I certainly hope it will all be over on the first day. Can anyone please share some personal experiences or further knowledge about the amount of time it will take (or even any similar shoplifting stories at all)? I'm meeting with a lawyer next week so I'm sure he'll be able to answer most of my questions, but as of now I'm freaking out and would appreciate any info/advice.

Also, what is the difference between Petit Larceny and Petty Larceny?

Both terms mean the same.

Nothing. "Petty" is a phonetic transcription of the French word "Petit". In French, "grand" means "big" and "petit" means "small".

Oh thanks. I figured they meant the same thing, but wasn't entirely sure. Odd that they don't just stick to one.

Does anyone know what happens when the police confiscate a "burglary tool?" Which in this case were small, sharp scissors? They were not used. But does it show intent? Will my charge be brought up to a felony? My summons says "Petit Larceny." I suppose a judge can change that?

Because of the tool you can be charged with burglary however if they havent upped the charge yet I don't feel they will at this point

Well I haven't even been to court yet. So you don't think the judge will try to up it? I mean I know that there is a possibility that he or she will. But from what you've said and what I've heard, I'm guessing/hoping that they won't.
