    Charged with Felony - Effect on F1 Visa
    I unfortunately got involved in an aggravated assault case on campus and have been charged with a Class C felony. I do not have any record of any trouble with the law in the past.

    My lawyers have told me that it would be reduced to be a misdemeanor if I plead guilty and I will face no jail time. Although I would be paying some fines.

    How will this affect my F1 Visa? I would be renewing the visa in one year from now. Will it affect me then.

    How long do I have to wait to get the records completely removed?

    Plz help me

    You should consider having your situation reviewed by an immigration lawyer before you enter your final plea, so that you can help minimize or avoid any immigration consequences..

    There is a minimum five year waiting period before you can apply for the expungement of a Michigan criminal record. Expungement is not likely to change the way USCIS would view the incident - that is, they have been known to decline to recognize any pardon or expungement that is not based upon a finding of innocence.
