Am I A Runaway?

I am 16 years old and I want to live with my mother. My Parents were married for 9 years and divorced when I was 10. My parents have joint custody but my father is the primary who lives in Minnesota. I'm in Colorado with my mom for the summer because that is where she lives. I want to stay living here because my father constantly yells at me and his wife isn't any better. My father also has no job and no prospects for a job. He depends on his wife for support. His only income is what my mother sends him in child support, which I have never seen anything of. My Father's Wife's children get anything they need while my brother and I suffer with the absolute bare minimum. When I brought up the desire to live with my mother the first time when I was about 13 he yelled at me for an hour and constantly tells me how horrible of a person my Mother is. My father refuses to let me live with my Mother right now and I'm wondering if I just don't go back to Minnesota will I be considered a runaway and can my Mother be arrested for Kidnapping or housing a runaway?

No but if there is a court order that says your Father has primary custody then your Mother could be in contempt of court. Ask your Mother to petition court for custody change.

What will happen to my Mother if she's held in contempt of court?

It wont get to that if she files proper legal papers in court that hold juridiction in custody case. Being held in contempt will only lessen any chances of getting what she wants. You cant just decide to live where you want there are court orders in place any change must be through court
