Support and Visitation

I am the father of two children. I was ordered to pay child support in the divorce decree. The first problem was that I was ordered to pay too much money according to the percentages; but I still tried to pay. Because I haven't been able to pay it all, of course now I'm behind. But that's not the big issue. I've been paying. My ex has had a time taking the case in and out of the child support system at will when she's upset with me. Last year, she told the court system that I hadn't been paying anything when I had actually been paying money directly to her (because she told me that it wasn't in the court system anymore). She told DHR that I hadn't been paying anything, they contacted me and subsequently, the case was taken out of the system. She agreed that she could get the money from me quicker than if I'd been sending it to the system and then waiting on them to send it to her. My question is three fold: 1. Can she continuously take the case in and out of the court system when she gets ready? 2. Isn't there some time frame for the amount of time she has to put the child support case in and out of the system? 3. Didn't it constitute fraud when she advised the system that I hadn't been paying money when in fact I have all money orders and cancelled checks where she's been receiving payments (because accroding to her they told her not to accept any more money from me after she filed for child support? Please help so that I can take further action if necessary.

There are a couple of things you need to do ASAP- one- file for a modification of the CS if your order wasn't according to the guidelines.
Two- get the entire thing put back into the system where you will pay through the CSE and court. NEVER pay anything directly to an ex without having SOLID proof of payment.

Thanks. What's considered SOLID proof? I have cancelled checks with her signature and copies of all money orders. I even had a bank account set up that I would put monies directly in to so she'd have better access to the child support. My greatest problem is that she's trying to say I never gave her anything when I've been supporting them all the time. I'm also having problems with visitation which I know I have to go back to court for......Any suggestions.....

All of those things should be solid proof that you can use in court. Do you have any of the deposit reciepts from that account? If so, they will also be useful.
