Violating Probation By Not Paying Fines
I am recently being charged with violating probation by not paying my 1476.00 in court costs. I could not pay this because I just had a child and couldnt afford it, which I explained to my probation officer at the time. She told me that she was going to violate me, but to pay the fine as soon as I could. My probation ended september 2004 with a warrant for violation. I have recently been arrested in a different county for arguing with my wife and pushing her after a night of heavy drinking, being charged with simple battery. So I was bonded on the warrant for $5000.00 and am awaiting my court date. Although I did not pay my fine, I did my 100 hours of community service, did my dui schooling (the original charge obviously being DUI, my second), reported every month paying 50 dollars, and fulfilled everything else. What do you think I am looking at if before the court date I pay the fine?

Did you get a suspended sentence? If so expect to serve the sentence. By the way base on your post alone you might seek help for your drinking issues.

what is a suspended sentence? the probation dept. also said if I pay the fine now, that when I go to court everything would be satisfied so I should not be looking at any jail time (which is my biggest concern). I have a wife and a 3 year old son whom I am the sole provider, if I go jail everything will crumble. And will a lawyer help me in this situation?

If you keep drinking your family will crumble as well. Suspended setnence is simple. Judge gives you 60 days in jail but "suspends" it pending your successful completetion of probation terms. Even if there was no suspended sentence you could still get 30 days for probation violation

Believe me I know that but do you and are you ready to do something about it? How do I know simple I am a 21 year sober Alky done it all. Heres a brief list

    5 DUI arrests
    1 Probabtion violation
    Numerous days in jail
    over one dozen auto accidents
    Totaled 5 or six cars
    Broke my hand
    Broke my ribs
    Nearly lost my right eye
Doctor pulled over 100 pieces of glass out of my face
Lost love and respect of nearly all my family members
Lost at least half dozen jobs (many with bright futures)
Crapped my own pants while walking public streets (more than once)

Thats a small list so believe when I say I know what drinking can I mean it! I also know what a sober life can do. I cam make that list as well but this is too long already.PM me if you want that list
