H1B Transfer After Job Termination
Hi,
I was terminated from my current employer and they promised me that they will not cancel my H1B. My last day was 31 June 2007.I have cleared interview from another company and they are doing my background and educational checking. That process will take one more week. So hopefully ,my future employee will file my H1B Transfer in Last week of July / first week of august.
My questions are
1. is there any grace period to file H1-B transfer after terminated from the current employer?
2. When my future employer file my H1B, i can provide pay stubs up to June 2007 only. I can't provide my Jul 2007 pay stub will it be a problem?
Please guide me.
Re: H1B Transfer After Job Termination
After you lose your job you have an unofficial ten day grace period to pack up and return to your country of origin. There is no grace period for a "transfer". Is there any chance that your former employer would classify you as being on an unpaid vacation or leave of absence to bridge the gap? If not, I suggest consulting an immigration lawyer.
