Name Change of Minor Child Without Consent of Biological Father
I'm orginally from Pakistan and after moving to the United States seven years ago with my now, 10 year old son, I am now a U.S. Citizen (my son is too). I have no idea where my son's biological father is and have not spoken to him since he granted me permission to leave Pakistan with our son, seven years ago. I want to change my child's last name without his biological father's consent since I cannot locate him and he has had nothing to do with his son for the last seven years. Do you think after filing a petition, this can be granted in the State of Florida?

Are you still married to the father? Do you believe the father remains in Pakistan? Where was the child born?

We were never married, that is why I left Pakistan with my son. He was born in Pakistan. I believe his father is still in Pakistan but I have not had any contact with him in seven years since I left.

You can petition for a name change through the California courts. You will have to attempt to serve the father with notice of the hearing or, if that cannot be achieved, obtain court permission for substituted service. If you wish to have the order applied in Pakistan, you will have to check with a lawyer in Pakistan to see if that country would respect a U.S. name change order.
