    Caught Shoplifting in Kohls
    hi,

    I am 29 yrs old Asian resident working on L1. I was caught shoplifting from Kohls, merchandize worth 34$. They have taken my pic and made me sign trespassing doc and another acceptance document stating I had taken that stuff. But fortunately they do not have my Id or SSN info or even my correct address for correspondence. Also they did not call the police. I just want to know if I am in some kind of serious trouble ... or more still how does target ensure a person is not trespassing. Say I dont go to that particular store again and visit some other Kohl's location (not for shoplifting though), do I have a problem. I know that was a blunder I commited. I did get carried away, but I dont want to repent all my life for that one mistake. Nor do I want to cut a sorry figure in front of my frnds n family if I go out shopping with them. Please advice

    What is this post about? You say you shoplifted at Kohls, gave them false information and now what?

    Then you ask how Target ensures a person is not trespassing?

    Then you say that you have a problem? You got carried away?

    Then you don't want to look bad in front of you friends? Don't go to ANY Kohls. They have a digital video system and traveling security agents. That means, they sent your picture to ALL Kohls to be on the lookout for. If you get caught shoplifting at a Kohls again, you will be in the system and they will charge you. I do think that you should have been charged in the first place, but oh well.

    What I meant was that can I ever visit any Kohls location again. Will they be in lookout for me everywhere. Certainly I am not going to repeat this mistake ever again in my life in any of the stores. I seriously regret what I did, and I am not able to face myself aftr that. Also I will not have the courage to face my family n frndz if anyone gets to know abt this incident.

    So if I am alone I will make sure I dont ever go there, but if I am shopping with any of my frndz what do I tell them why cant I go inside Kohls. Thats the reason I am so scared.

    As regard Id and other information I did give them correct name, though SSN & other details could not be furnished.
    Still is there any remote possibility of them filing a case against me?

    Please let me know if ever I enter any of there premises under any circumstances am I liable to charge even if I am not stealing?

    Plus for how long am I not supposed to go there?

    If you enter a Kohl's "anywhere" and for some reason you are recognized as a subject who had been banned you can be arrested for trespassing. furthermore sinc eyou gave flas einfo they could also decide to charge you for the shoplift now providing they preserved the evidence

    Thanks for your suggestion. I will make sure that I abide by this decision.

    Can I ever be eligible for expungement of this record. (Could be in due course of time)

    Correct me if I am wrong there was no Police involvement? You gave false info anyways. You have no court date and arent going to have one since by your own post charges were not beign filed, whats to expunge?

    Hi,
    Yes there was absolute no police involvement. The expungement is desired from the ban to enter Kohls. Trust me I am not into this shop lifting stuff and made this one time mistake of my life. I really want to come out of this memory without losing the lesson. Is there any hope.

    If retailer has discovered you gave false info I would not enter store! They still can press charges on you and add the false info to crime or at very least state you were uncoopertive. If you ask to again shop at store they will possibly ask for your info to look up the incident to see if they want you to return or if its just a bad choice not bad person. It is not in your best interest to bring more attention to yourself on this matter. Since you gave false info they were unable to send you Civil Demand. No you do not want to enter this store.

    I don't know of any state which criminalizes giving false information about your identity to store security. But no, nobody here on a non-immigrant visa (or for that matter an immigrant visa) should be breaking the law, lying after being caught stealing, or trespassing.

    Perhaps my meaning was poorly worded. My suggestion is that if store is aware of the false info. (Civil Demand return to sender would suffice) That if OP went to store to have ban lifted they could then file charges for the shoplift if they have perserved evidence. Since OP decided to give false info to store Civil Demand could not be issued. The recourse could be prosecution.
