My Husband is Going for a Master Hearing
My husband has a old aggravated felony case of 11 years ago, he pled guilty and recieved 5yrs probation in August 1996.(Attept to sale controllable substance). On July 1st, 2007 he recieved a letter for him to appear for his master hearing for deportation proccedings. We have been together for 10years, married for 2yrs and have to U.S. citizen Children as well as myself. What can be done, Do I have a chance to fight for him to stay in the US. He has been arrested one time only and has been clean ever since. He has his own business, house, and pays taxes. Do he have a chance to get a waiver. All this surface because he apply for citizenship in 2004 and was not aware he could not become a citizen with a aggravated felony.

It's unlikely that his conviction won't result in deportation. You haven't stated any basis for a waiver, although we don't know the facts so we can't rule out the possibility. He should consult an immigration lawyer.

Our Lawyer said we can not get a wavier because of his type of felony. Well we will not know what will happen until Sept 5 at the Master Hearing. I hope he don't but I think they will because the laws on aggrevated felony are very harsh since April 1996.
