Emancipation Procedures In Tennessee
I am curious if someone can give me the details regarding emancipation in Tennesse. Is it possible ? If its not possible can someone point me in the direction to read the subsect of presidence of why emancipation is not admissible. The problem exists around a friend who is soon to be 17, I know of her through her older sister and she has asked my opinion on emancipation. I would like to know if its at all possible since she has said that there are times when there is physical abuse on the part of her younger brother (14) and also, there are times when her mother will physically abuse her as well. The home life is very unstable and she has made other claims as well that bring up a red flag but due to the complexities of the entire situation it needs to be handled very delicately for all the parties involved. She was told that if she did attempt to get emancipation and it didn't work out she would be ejected from the home and placed into a juvenile care program for troubled teens of some sort. Being that I am not a resident of TN I need a crash course in TN law in regards to emancipation, so please has much information as available would be of great help.

Abuse is not what emancipation is about. If teen is being abused then a CPS report should be filed. Emancipation is about self support

Emancipation takes along time to go through the courts, assuming she would even qualify. Only about a dozen cases are successful in the whole COUNTRY. And even if she was emancipated, that would not help her brother who is being abused, would it?? Don't you think it would be better to report the abuse to Child Protective Services and help both of these kids be safe??

Tennessee has no emancipation statute. Tennessee Legal Aid indicates that it is possible, but with no statute the circumstances under which a court might grant emancipation will vary by court and judge. A Tennessee family lawyer may be able to advise you of any common law processes.
