Reentry After Deportation
Hi All,
My mother and my sister are being detained at the family shelter awaiting deportation. I'll try to make their story as short as possible: Back in 1997 My mom dad and sister came to the US on a visitor visa and applied for political asylum. In 2002 the asylum case was denied followed by them appealing multiple times. During that time my mom and dad got divorced, my mother met somebody else (a US Citizen) and married him in 2004 AFTER all the appeals were denied and she was told to voluntary depart. My mother and her new husband immediately filed for readjustment of status and were waiting on the approval. During the time between 2004 and 2007 my new step-father got into a car accident, injuring his back that rendered him unable to work and file for disability. My mother finished nursing school, was working and taking care of her new husband who was fully dependant on her. On May 5th 2007 the INS came to their house, picked her and my sister up and based on failing to voluntary depart the INS detained them in the family shelter. My step-father has tried everything to stop the deportation, went to multiple attorneys, went to the congressman and tried seeking help from the jewish community, but everything failed... I am trying to help him as much as possible, but at this time, their new house is going into foreclosure, he is unable to pay bills and filing for bankruptcy... The poor guy's life is becoming more difficult everyday, he cannot work and support himself, while needing medical treatment every few months (injections into his spine to help him to walk without constant pain). The INS, ofcourse, does not care about that and forcing the law upon my mother and sister, trying to deport them as quick as possible. My mom has never had any felonies, never being arrested, paid taxes since the very first day she began work in the US, went and finished nursing school and was supporting her new disabled husband while building normal life for the whole family.
At this point, after talking to many different attorneys, we see only one way out.. the I-212 form that can be filed by my step-father after my mom leaves the country. What are the chances of her coming back? She will not have normal life in Russia, my sister cannot even speak Russian well, and now her husband, who is an american citizen lost all of the financial and moral support here. Can anything be done to help them?
