I Can't Take My Home Life Any More

Hi, I am 15 years old, I live in SAN DIEGO, CALIFORNIA and i wish to become emanicipated. I make about $300 a month right now but i am looking for another part-time job. I Currently go to Charter School of San Diego and I am currently planned to graduate in the spring of 2008 after i turn 16. I live with my mother and things are not good. she constantly lies, is disrespectful to everyone and wants to control every aspect of my life. she dates men who brings drugs into our home and lies to the cops that way she doesnt lose her kids she is mentally controling as well physical. She is also mentally abusive. I have bipolar and i am trying to control it with out medication and being in the enviroment that i am in it causes me to be stressful and angry. she sets ridicoulous rules and trys to control everyone in her life. its a hell hole. i have tryed to leave before to avoid agruments but she makes me stay by her and continues to argue. i want to video tape how she acts and the enviroment she creates for a court room to view if i do emanicipate is that a good source of proof and reason? Many people have offered to take me in but she says no and would rather send me to my physically abusive father recognized by CPS, or my elderly grandparents who all live in different states. A family friend has fought to have custody of me because she knows the outstanding conditions that i live under and wanted to have guardinship over me but when my mother found out she put a restraining order over her. I have called cps and when they come to my house my mother lies and tells them that i make up stuff and that everything is all on me. she hides he truth from everyone about how she really is and trys to make me look like an out of control teen. which is not the case. I have looked over my 3 younger sibilings since i was 8. i have cooked for them cleaned and have lived the life of an adult for years now. she is currently preganat and i dont want to have to take care of her baby coming.
i need to find a temporary place to stay and i have one set up but if i leave she will call the cops on me what do i do??? and what is your opinion on the situatuion??

$300.00 a month will be enough for self support. Getting another job and having one are two different issues. What about school? What is your self support plan? Where will you live? etc etc. By the way even though Ca emancipation laws allow for children under 16 to be emancipated that is normally reserved for child stars and atheltes. If there are abuse issues in your home talk to a school counselor or Doctor about this abuse they are mandated to report such crimes.

well school i go 2 hours 2 times a week and i never stop going i dont get breaks for school like tradtional schools do. i plan on doing my junior year in the fall or winter and applying to college at fidm or spelman. I want to go to school for fashion and design and also graphic design. i also wanted to be a doctor or lawyer but changed my mind. right now my best friends family are wanting to take me in until i graduate then i plan on living in student residency at fidm. Well i also am an trying to book modleing and acting jobs. i have tried but my mom is good at covering things up. even emotional abuse is consider extreme enough for them to contact cps?

Living with friends is not self support. You still don't have that second job and your plan for college and two jobs wont work either. The judge will have a difficult time seeing as emancipation will benefit you. Any abuse can be reported now if it can be proved is separate issue. However once a CPS invesitgation begins other resources will become availalbe. I don't see as how you will be success in any emancipation peition based on your post.

well here is my game plan for now.

1. continue going to school
2. apply to FIDM ( fashion institue of design and merchandising) for early applicants
3. while i am continuing to go to highschool i plan on finding another part-time job
3a. with that money i plan on takin an amount and putting it into a savings certificate and and also opening a savings account. that way i always have money no matter how bad times get.
4. now if i can not stay with my mom while the emancipation is taking place or if things get to bad i plan on renting a room from my friends mother.
4a. if that is the case then i plan on paying her rent and anything else, and wait till i graduate and start school in the summer or fall where i then plan to live in the student resiendies that they have available.
5. at that college they have interships available and i plan on doing one of them if possible and also setting up a job that i can have when i go to school.
6. i also plan on applying for a provisional license at 16, because of my permit holding of 6 months
7. right now i pay my own bills and clothing and food
8. if i can not emancipate then the same plan applys but i will move out a t 16 to go to college
8a. but if i do not emanicpate are there rules against me moving in with my friend and her family without my mothers permission if i believe it will cause more issues to ask her??

You may leave your parents home with permission.

Your plan isnt a plan it deals with maybes! A plan shows how much you make how you wil lpay your bills and get an education. In short.

When you actually have that second part time job, and can outline a plan for how you are going to pay rent, food, utilities, clothing, medical care, transportation, school supplies, internet connection, shampoo, shoes, and all the other bills you are not paying for on $300 a month, it will be time enough to talk about emancipation. Until then you are wasting your time even considering it.

You cannot move out without your parents' permission until you are 18.

Ok lets play pretend with your $300.00

Rent (for room not apt) $200.00 a month
Thats leaves $100.00 for grocery, Gas, Elect, phone, internet, transportation, medical to name a few.

You cannot do this on $300.00 get the second job then look into this

if i am in a situation that i am so stressed out that it is causing me to be depressed and un social how am i supposed to deal with that??
i understand that but i pay my phone bill, i buy my own clothes, my own food to eat, and at the college that i plan on going to the rent includes already furnished aparment with internet access, cable and utilies are all in the rent. i have been saving up and have funds to support myself and i am continuing to get money to support myself and because of my military dependent status i get help with school scholarships and i plan on applying for scholarships and what not i have a savings fund just for college that i have been putting money in for years now... sooooo its not like i dont have a plan or a way to live...

getting the second job is what i plan to do already.
that really is the only thing keeping me from this process..
but other than that i feel i have the potential to be OUTSTANDING in my life goals with emanicpation.

No thats not the only thing its just the simple one to focus on. Read the statute. By the way in georgia (used as exmaple) in 2005 had over 10,000 peitions for emancipation about 12 were granted! Now that can used as model for success it isnt easy and isnt suppose to be. Google the statute.

well from allthe other people i have discussed this with they agree that i will do fine on emancipation and will even write recommendations me counslers and pyscologists so i think that i will proceed with emanicpation..
and if that is not an option then i need to find a way that a family friend or relative can ask the court for custdy of me...

and i have had people from court programs read me it.

Nikki, when you can go to the judge and say, this is what I HAVE done, not, this is what I am GOING TO do, you will be in a position to ask for emancipation.

Not, I'm going to get a second job, but I HAVE a second job.

Not, I'm going to apply for an internship that comes with an apartment, but I have been granted an internship that comes with an apartment.

Not, I'm going to apply for a scholarship, but I've been granted a scholarship.

You will not be granted emancipation on maybes. The judge is not going to emancipate you on the basis of things that may not happen. What if you can't find a second job right away? What if you are turned down for the internship? What if you don't get the scholarship? What if your grades go down when you're working two jobs? When you have these things already in place, then you can apply for emancipation. It will NOT be granted based on,
"well, I'm going to..." but on "I have".
